Lascon Storage Network (the LascoNet)

Introduction

Welcome to the Lascon Storage Network (hereafter termed 'the LascoNet'),a business networking site where storage professionals can connect with their peers to share ideas or for to seek advice. Before joining the LascoNet you must agree to be bound by these terms of service. Some information is also available to non-members and if you are not a member then you must agree to these terms of reference before accessing that information. If you do not agree to these terms of service, then do not join or access the site.
Lascon Storage and the LascoNet are wholly owned by Lascon Storage Limited, a company registered in Scotland, UK

We reserve the right to change these terms at any time, and it is your responsibility to regularly check the terms and conditions and note and agree to any changes.

Access to the LascoNet and content

We will endeavour to allow uninterrupted access to the LascoNet, but access to the LascoNet may be suspended, restricted or terminated at any time.

We reserve the right to change, modify, substitute, suspend or remove without notice any information or service on the LascoNet from time to time.

We assume no responsibility for the content or services of any other Websites to or from which the LascoNet has links.

Eligibility and Membership

Members of the LascoNet must be at least eighteen years old. the LascoNet is not available to minors, suspended or banned members. Each individual may only sign up for one account on the LascoNet, multiple accounts are not permitted. Usage of the LascoNet is free a this time, but we reserve the right to charge a fee for usage in future.

Usage of Your Account

When you register with the LascoNet, you will be asked to supply an e-mail address as a username, and a password. You will be responsible for all activities occurring under your username, with our without your knowledge, and for keeping your password secure. If you think that your account is being used fraudulently then you must inform the Administrator at the LascoNet immediately. the LascoNet will not be liable for any damages or loss resulting from fraudulent use of your account.

Your Conduct on the LascoNet

the LascoNet is intended for storage related business use only. You agree not to use the LascoNet for any illegal activity. Specifically, you agree to abide by all applicable local, national and international laws and regulations and you are solely responsible for all content published in your home space, or comments made by you in other's spaces or group areas. Restrictions include, but are not limited to:

You will adhere to the laws governing data transfer in your country, and in the laws governing such transfers in Scotland, the United Kingdom and the European Union
You will not collect email addresses or any other contact information of Members from the LascoNet by electronic or other means.
You will not defame, abuse, harass, stalk, threaten or otherwise violate the rights (such as rights of privacy and publicity) of others.
You will not publish, distribute and/ or disseminate any harmful, obscene, indecent, unlawful, libelous, profane, defamatory, infringing, inappropriate, hateful, or racially, ethnically or otherwise objectionable material or information.
You will not use other Members' personal data for purposes other than establishing contact without their express permission.
You will not submit Materials that are unlawful or promote or encourage illegal activity or that would violate the property rights of others.
You will not submit Materials of any third party without such third party's prior written consent, or Materials that falsely express or imply that such Materials are sponsored or endorsed by Lascon Storage
You will not create a false or misleading identity of, including, but not limited to, a Lascon employee, or falsely state or otherwise misrepresent your affiliation with a person or entity, for the purpose of misleading others as to the identity of the sender or the origin of a message or to harvest or otherwise collect information about others.
You will not transmit, email or post any material that contains in any form software viruses or such programs as including but not limited to, Trojan horses, worms, time bombs, cancel-bots, computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
You will not use the LascoNet in any unlawful manner or in any other manner that could damage, disable, overburden or impair the website.
You will not attempt to gain unauthorized access to the LascoNet, other accounts, computer systems or networks connected to the LascoNet, through password mining or any other means.
You will not reformat or frame any portion of the web pages that are part of the LascoNet.
You will not disseminate content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary right of any party or infringes any intellectual property law or any other applicable law.
You will not remove any copyright, trademark or other proprietary rights notices contained in the LascoNet.
You will not disseminate any unsolicited or unauthorized advertising, promotional materials, 'junk mail', 'spam', 'chain letters', 'pyramid schemes', or any other form of such solicitation.
You will not interfere with another Member's use and enjoyment of the LascoNet.

We may, but shall have no obligation to, remove Materials that we determine in our sole discretion are unlawful, fraudulent, threatening, libelous, defamatory, obscene or otherwise objectionable, or infringes or violates any party's intellectual property or other proprietary rights or these Terms of Service. Further, under no circumstances does Lascon Storage have any obligation to check the accuracy or truthfulness of any Materials, nor to monitor any Member's use of the LascoNet.

We also reserve the right to suspend or ban any members who persistently break these terms of service

Intellectual Property

The User content that you provide in your home area is yours and Lascon Storage does not claim any ownership or rights to that material. However we, and our Service Provider, do retain the right to make copies of that material for data storage to assist with the operation and recoverability of the Site.
Any other content on the LascoNet, including designs, text, graphics, pictures, video, information, applications, software, and other files, and their selection and arrangement (the "Site Content"), are the proprietary property of Lascon Storage, its users or its licensors with all rights reserved. No Site Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the Company's prior written permission.

Provided that you are eligible for use of the Site, you are granted a limited license to access and use the Site and the Site Content and to download or print a copy of any portion of the Site Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except for your own User Content, you may not upload or republish Site Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Site Content is strictly prohibited.
Such license is subject to these Terms of Use and does not include use of any data mining, robots or similar data gathering or extraction methods. Any use of the Site or the Site Content other than as specifically authorized herein, without the prior written permission of Company, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms of Use shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time without notice and with or without cause.

Limitation of Liability

We use reasonable endeavours to ensure that the data on the LascoNet is accurate and to correct any errors or omissions as soon as practicable after being notified of them. However, we do not guarantee that the LascoNet will be fault free and we do not accept liability for any errors or omissions. We do not monitor, verify or endorse information submitted by us or third party providers for inclusion on the LascoNet and you should be aware that such information may be inaccurate, incomplete or out of date. To the extent permitted by applicable law, we disclaim all warranties, terms and representations (whether express or implied) as to the accuracy of any information contained on the LascoNet.

We do not give any warranty that the LascoNet is free from viruses or anything else which may have a harmful effect on any technology.

Due to the nature of electronic transmission of data over the internet, any liability we may have for any losses or claims arising from an inability to access the LascoNet, or from any use of the LascoNet or reliance on the data transmitted using the LascoNet, is excluded to the fullest extent permissible by law.

Nothing in these terms and conditions excludes or limits our liability for death or personal injury caused by our negligence or for our fraud.

Subject to the liability which we accept above: (a) our aggregate liability to you arising out of or in connection with this agreement or use of the LascoNet shall not exceed �100; and (b) we shall not be liable in contract, tort or otherwise howsoever arising out of or in connection with this agreement or use of the LascoNet for any indirect loss, consequential loss, loss of profits, data, revenue, business opportunity, anticipated savings, goodwill or reputation.

The clauses above do not affect your statutory rights.

Governing Law

The Terms of Agreement between you and Lascon Storage will be governed by Scottish law without regard to conflict of laws principles.
